El ruso Igor Vladimirovich Bitkov declaró ante el Tribunal de Mayor Riesgo A que pagó US$50 mil por los documentos de cada miembro de su familia, que en 2009 estaba conformada por su esposa Irina Viacheslavovna Bitkova y su hija Anastasia Bitkov.

Según el sindicado, dentro del paquete de documentos ellos solicitaron que se incluyera el Documento Personal de Identificación (DPI) –en ese entonces era utilizada la cédula de vecindad-, el pasaporte con nacionalidad guatemalteca, la partida de nacimiento y licencia de conducir, pues la que traían de Rusia no era admitida como válida para Guatemala.

Además, dentro de ese paquete la empresa Cutino Internacional incluía la constitución de una entidad mercantil, las cuales según el portal electrónico de guatecompras, tenía como actividad económica la venta al por menor en puestos de venta y mercados. Bitkov intentó justificar sus acciones aduciendo que no sabían que se trataba de un negocio anómalo, ya que incluso fueron llevados a una sede del Registro Nacional de las Personas (Renap), donde les tomaron fotografías y huellas dactilares, para incluirlas en la documentación.

Asimismo, señaló que la empresa tenía la apariencia de legalidad, porque contaba con gran cantidad de personal laborando en un edificio similar a un palacio, y como su familia no dominaba el idioma español, el abogado de Cutino se encargaba de realizar todos los trámites.

Otra de las justificaciones que Bitkov utilizó fue la de una persecución política orquestada por el gobierno de Vladimir Bitkov y su hija durante la declaración dada ayer al Tribunal de Mayor Riesgo A. Putin….

Por su parte, Irina Bitkova y su hija Anastasia (acusadas de uso de documentos falsos, supresión y alteración al estado civil y usurpación) se abstuvieron de declarar después de intentar hacerlo solo para detallar la persecución que les habría provocado buscar refugio en Guatemala.

CAPTURA DE LA FAMILIA BITKOV

Los tres integrantes de la familia Bitkov, fueron detenidos el 15 de enero de 2015 en el residencial Casa y Campo, ubicado en el kilómetro 23.5 carretera a El Salvador, donde las autoridades decomisaron vehículos, documentos y una fuerte suma de dinero.

Las dos mujeres de la familia fueron beneficiadas con medida sustitutiva el 15 de enero del año pasado, pagando Q20 mil cada una, y obligadas a firmar el libro de asistencia una vez al mes y con la prohibición de salir del departamento de Guatemala; pese a que Bitkov también había solicitado la medida sustitutiva, el juez de Mayor Riesgo B, Miguel Ángel Gálvez, se la denegó.

41 IMPLICADOS

En el caso se encuentran 41 personas sindicadas de conformar y utilizar una estructura criminal que se dedicaba a facilitar pasaportes falsos a ciudadanos de distintas nacionalidades.

Entre los acusados se encuentran funcionarios del Renap, de la Dirección General de Migración (DGM), abogados, tramitadores y usuarios extranjeros.

En el caso están involucrados nueve exempleados de Migración, quienes según el MP, emitían los pasaportes a personas que realizaban pagos de entre US$5 mil y US$8 mil. Además, se encuentran involucrados extrabajadores del Renap, que avalaban el estado civil de los beneficiados con pasaportes.

Testigo protegido clave en la investigación

Según el Ministerio Público, el exempleado de Migración Carlos René Gómez Díaz testifi cará en el debate oral y público en contra de los 41 implicados, donde detallará la forma en que se extendían los pasaportes con documentos falsificados o alterados.

No cabe duda que el tema de la migración y el desarrollo es importante. Este año, las deliberaciones mundiales sobre los migrantes se han centrado justamente en esa cuestión. En octubre, los Estados se reunieron en Nueva York para el segundo Diálogo de Alto Nivel sobre la Migración Internacional y el Desarrollo. Prosiguen las deliberaciones sobre la agenda para el desarrollo después de 2015 y sobre la inclusión de la migración en dicha agenda. Sin embargo, debemos tener en mente que:

Los migrantes son, ante todo, seres humanos con derechos humanos y no se los puede considerar o presentar únicamente como agentes de desarrollo económico.

No se debería considerar o presentar a los migrantes únicamente como víctimas indefensas que es necesario rescatar ni como delincuentes impostores. Las autoridades estatales tienen la responsabilidad de combatir las expresiones de racismo y xenofobia, de formular cargos contra los perpetradores de actos de violencia o discriminación contra los migrantes y de fomentar un discurso público que promueva una mentalidad abierta a las diferencias, la aceptación de los cambios sociales y la celebración de la diversidad.

En ocasión del Día Internacional del Migrante, queremos recordar a todos que:

Los derechos humanos son el tema central de todos los debates sobre los migrantes y las políticas migratorias.

Todos los migrantes, en virtud de su dignidad humana, están protegidos por el derecho internacional de los derechos humanos, sin discriminación, en condiciones de igualdad con los ciudadanos, independientemente de su situación administrativa o de su condición. Sin embargo, a pesar del marco jurídico existente, los migrantes en todo el mundo siguen sufriendo abusos, explotación y violencia.

En la Declaración del Diálogo de Alto Nivel, los Estados adoptaron un lenguaje de derechos humanos para tratar asuntos relacionados con la migración en las Naciones Unidas. Sin embargo, todavía hay cierta renuencia a adoptar las Naciones Unidas como foro central para abordar las políticas migratorias.

Los Estados siguen tratando de regir la migración principalmente a nivel unilateral o bilateral, y eso ha llevado a una falta de coherencia en la gobernanza mundial, regional y nacional y a un retroceso respecto de los marcos vinculantes de las Naciones Unidas, que se manifiesta en una preferencia de los Estados por procesos informales, como el Foro Mundial sobre Migración y Desarrollo y los procesos consultivos regionales. Sin embargo, estos foros y procesos, al no ser de índole normativa, no tienen un enfoque sólido de derechos humanos ni mecanismos de seguimiento y ejecución.

Aunque tales foros son necesarios para fomentar la confianza política entre los Estados en asuntos que son delicados desde el punto de vista electoral a nivel interno, los migrantes necesitan que esta confianza se transforme en acuerdos más formales y en herramientas para formular políticas válidas dentro de marcos de cooperación formal, como las Naciones Unidas.

Teniendo en cuenta los resultados el Diálogo de Alto Nivel, instamos a los Estados a que consideren en sus políticas migratorias nacionales asuntos como los siguientes:

• la despenalización de la migración irregular;
• la búsqueda de alternativas frente a la detención administrativa de migrantes en situación irregular;
• el combate de la xenofobia y la discriminación contra los migrantes;
• los derechos de los niños migrantes;
• los derechos económicos, sociales y culturales;
• la protección efectiva de la vida y los derechos humanos en las fronteras internacionales; y
• el acceso válido a recursos para los migrantes que son víctimas de violaciones de derechos humanos.

También instamos a los Estados a que ratifiquen todos los tratados internacionales y regionales de derechos humanos, entre ellos la Convención Internacional sobre la Protección de los Derechos de Todos los Trabajadores Migratorios y de sus Familiares, y a que los implementen plenamente.

En última instancia, tal como ha ocurrido con otras categorías de seres humanos marginados, el objetivo debe ser empoderar a los migrantes para que defiendan sus propios derechos. Se les deberían ofrecer instrumentos normativos, institucionales y procesales que los protejan de la precariedad contractual o situacional y que les den acceso efectivo a la justicia y a recursos apropiados.

Se debe facilitar el acceso de todos los migrantes, incluidos los que se encuentran en situación de irregularidad, a agentes sociales tales como personal de salud, personal escolar, inspectores laborales, trabajadores sociales o la policía local, sin temor de que los arresten, los detengan o los deporten simplemente por pedir ayuda.

Tales agentes deben estar en condiciones de cumplir su importante misión social sin interferencia y hay que establecer “cortafuegos” entre los servicios públicos y los organismos de aplicación de las leyes de inmigraciones. El acceso a la justicia también es fundamental, ya que los tribunales, las instituciones nacionales de derechos humanos, los mediadores y otros agentes cuasi judiciales, a diferencia de los políticos, defenderán los derechos de los migrantes sin estar sometidos a presiones electorales.

El tema de la migración y el desarrollo siempre será importante al abordar los asuntos relacionados con la migración, pero no olvidemos nunca que :

Los migrantes son seres humanos con derechos humanos.

EL CASO DE LA FAMILIA DE EMIGRANTES RUSOS BITKOVS EN GUATEMALA

Luego de leer este artículo queremos compartirle el drama que están viviendo en estos momentos la familia de emigrantes rusos Bitkovs en Guatemala, en virtud que derivado de una persecución política por parte del gobierno ruso la cual aún son víctimas tomaron la decisión de migrar de su país de origen con el objeto de salvar sus vidas dejando todas sus empresas, bienes y familiares atrás.

Los Bitkovs Viajaron a varios países europeos como primera medida más se daban cuenta que a todos los países que viajaban los agentes de inteligencia rusa FSB les alcanzaban dándoles mensajes de amenazas las cuales ofrecían cesar a cambio de fuertes cantidades de dinero, por lo tanto ayudados del internet googlearon “Protección de Personas”  “Doble Nacionalidad” “Protección de Empresarios” “Antisecuestros” etc. logrando encontrar a la empresa internacional “CUTINO INTERNATIONAL” las cuales ofrecía una gama de servicios de protección en forma “Legal” en varios países de latinoamérica.

Los Bitkovs les contactaron por el SKYPE y hablaron del caso de persecución por lo que ellos les recomendaron venir a Guatemala para protegerse ya que este país latinoamericano en forma legal se le pueden dar nacionalidad guatemalteca y para protección extra para que los agentes de la FSB no les encuentren recomendaron el cambio del Nombre…. todo en forma #Legal.

La Firma Cutino International invitó a los Bitkovs a viajar a Guatemala para constatar que todos los procedimientos debían ser legales y como garantía de los mismos ofrecieron que todos los documentos de identidad y de viaje serían entregados dentro de las oficinas de gobierno tales como la Dirección General de Migración y el Registro Nacional de las Personas RENAP.

….y así los Bitkovs comenzaron una nueva vida en Guatemala logrando cambiar sus nombres y obteniendo su nacionalidad guatemalteca tal y como les había ofrecido  la firma Cutino International durante 6 años ! logrando vivir en paz y fruto de esa paz y felicidad Irina Bitkova e Igor Bitkov fueron bendecidos con el nacimiento de su hijo “Vladimir Bitkov Bitkova” quien nació en Guatemala.

Todo en la vida de los Bitkovs proyectaba que la persecución política había terminado pero fue entonces cuando el 15 de enero del año 2015 empezó una nueva tragedia y la “Cárcel esperaba a toda la familia Bitkovs” sin ellos saber el motivo de fondo que sería que sus perseguidores políticos les habían encontrado en guatemala y a base de mala información de descrédito contra la familia  orquestaron una campaña de difamación y calumnias contra la familia de emigrantes rusos a tal punto que lograron influir dentro del Ministerio Público de Guatemala y la Comisión contra la Impunidad en Guatemala CICIG contra la familia rusa con tal de llevarlos al juicio penal con el pretexto que había defraudado a el banco Ruso VTB Bank por una cantidad millonaria.. a lo cual contaremos mas adelante fue completamente falso mas para poder demostrar esta falsedad llevaría casi 3 años..

¿Que paso el 15 de enero de 2015? ….

Un Contingente de 60 Policías irrumpieron la paz de la Familia Bitkovs, el motivo aprehender a un papa, una mama, una hija y un bebe.

El 06 de diciembre del año 2017 dio inicio el juicio oral y público contra la familia Bitkovs dentro del caso conocido como “Caso Migración” dando un giro positivo para la familia de migrantes ya que sus principales autores de la ola de calumnias y mala información para esta familia en Guatemala el banco ruso BTV Bank fueron expulsados de la sala de audiencias por la jueza Jazmín Barrios…

¿Que ocurre ahora?

Se ha Solicitado el acompañamiento de la Procuraduría de los Derechos Humanos en Guatemala para velar porque los Derechos Humanos y de la Condición de Migrante de la familia rusa sea respetada a tal punto que se les exima de responsabilidad penal por el delito que se les acusa ya que la convención de palermo claramente exime de dicha responsabilidad a los migrantes.

El debate aún está en desarrollo estamos esperanzados que los nuevos jueces impartan justicia y logren reconocer nuestra calidad de migrantes y apliquen las convenciones internacionales en materia de derechos humanos y de migrantes para nuestra familia para que pronto estemos como familia nuevamente reunidos y podamos vivir en paz…
