Guatemalan President Jimmy Morales last week delivered a blow to an unaccountable United Nations agency by giving 11 of its foreign employees 72 hours to leave the country. In September he announced that the U.N. Commission Against Impunity in Guatemala, known by the Spanish acronym CICIG, must shut down within one year. Then he banned its top prosecutor from re-entering the country.

Late Friday a Guatemalan judge granted an injunction against the expulsion. But not before Mississippi’s Roger Wicker took to the U.S. Senate floor to declare that Guatemala, as a sovereign nation, has every right to expel CICIG, listing some of the commission’s past abuses.

More shady CICIG behavior has recently come to light, raising questions about related national-security risks it represents for the U.S., which funds it.

Aslan Mussin was executive secretary to the dictator of Kazakhstan from 2008 to 2012. But on Oct. 22, 2010, Guatemala granted Mr. Mussin permanent residency, a status that by law requires applicants to have lived in the country for at least a year. In other words, Mr. Mussin’s residency card, which allowed him to become a naturalized Guatemalan, was fraudulent.

CICIG has prosecuted a group of low- and mid-level Guatemalan bureaucrats for their roles in issuing fake documents. But the stamp and signature of the migration office’s deputy director, Mayra Véliz, were on the residency permits for Mr. Mussin and family members and scores of other Guatemalan permanent-residency permits, according to leaked documents.

Speaking to reporters in March, Ms. Véliz said “it has been determined that my signatures were falsified.” She didn’t say who determined that. She also said she hadn’t had time to file a complaint with the attorney general’s office—where she had become deputy. If she has done so since, she has not publicized it even though an investigation could clear her name.

Remarkably, CICIG has not prosecuted Ms. Véliz. Quite the opposite: In May 2014 she became deputy to then-Guatemalan Attorney General Thelma Aldana, who aggressively prosecuted defendants charged by CICIG. These include the Russian entrepreneur Igor Bitkov, his wife, Irina, and their daughter, Anastasia, arrested in 2015 for using false documents and tried in 2017 at Moscow’s behest.

CICIG was brought into the country in 2007 to confront rampant corruption. Yet it has violated the constitution, trampled civil liberties, and wielded its power with impunity. An April Helsinki Commission hearing on Capitol Hill, chaired by New Jersey Republican Rep. Chris Smith, exposed CICIG’s Russia ties and human-rights violations in the Bitkov case.

Most of Washington has turned a blind eye to CICIG’s reckless disregard for the law—with the notable exception of Rep. Smith and Sens. Wicker and Marco Rubio. This is a dangerous mistake. Foreigners can get a Guatemalan passport if they first secure permanent resident status. Once naturalized, they can travel visa-free to the European Union, Israel, Central America and most of South America. It can’t be a coincidence that the residency permits Ms. Véliz signed were for applicants from places like Kazakhstan, Russia, China, Iran, Libya and Syria.

Brave Guatemalans have been trying to get to the bottom of things. In 2014 an official inside the National Registry of Persons noticed that an inordinate number of national identity cards had been issued without the required fingerprints due to “amputation.” A January 2015 complaint filed with the attorney general’s office asked for an investigation.

One of the prosecutors assigned to the investigation, Heidi Tamara de León Muñoz, began to uncover fraudulent documents bearing Ms. Véliz’s stamp and signature. Ms. de León Muñoz told me by telephone last week that she was forced out of her job in January 2017.

The attorney general’s office said she was let go for poor performance. But her version of events is supported by the leaked documents, including a 2015 letter from José Francisco Pelaez Cordón, deputy director at the office of migration. In response to a query from the National Registry of Persons, he wrote that the migration office could find no supporting documentation for 84 foreigners who had been granted permanent residency. The vast majority of those permits contain Ms. Véliz’s signature.

In April the Bitkovs’ convictions were annulled by a higher-court ruling, which said that as migrants under the U.N.’s Palermo Convention and Guatemalan law, they have no criminal liability for fake documents they were given. But CICIG flouted the ruling; Mr. Bitkov is now on trial again for the same charges. No doubt jailing the family is what Russia wants and one reason why Mr. Morales is justified in asking CICIG to leave.

QUIEN FUE SERGEI MAGNITSKY

Cabe resaltar que los premios antes mencionados llevan el nombre del abogado y auditor ruso Serguei Magnitski fue cuyo arresto y posterior muerte en custodia atrajo la atención internacional ya que llevó a cabo investigaciones tanto oficiales como extraoficiales de fraude, robo y de serias violaciones de derechos humanos.

Magnitsky había alegado que hubo un robo a gran escala por parte del estado ruso sancionado y llevado a cabo por funcionarios rusos.

Sergei Magnitsky fue arrestado y eventualmente murió en prisión siete días antes de la expiración del plazo de un año durante el cual podía legalmente estar detenido sin juicio

La Ley Global Magnitsky fue aprobada en 2016 por el Congreso de los EEUU, es una norma estadounidense que se convierte en la lista negra para ciudadanos, influyentes empresarios y políticos señalados por abusos a los derechos humanos y actos de corrupción en sus propios países

La reputación del Banco Estatal VTB a nivel mundial y bancario es dudosa en virtud que la institución financiera ha sido sancionada por Estados Unidos y la Unión Europea de tal forma que los ciudadanos de estos países no pueden tener ningún negocio con el banco Estatal Ruso VTB.

Si hablamos de la reputación del presidente de VTB Bank Andrey Kostin ésta se vio sumamente comprometida por el escándalo que desató el caso de la familia Bitkov en Guatemala la cual es perseguida por el Banco Ruso VTB como un largo brazo de la injerencia del Kremlin en América, razón por la cual el cual en abril de 2018 Estados Unidos endureció las sanciones contra Rusia incluyendo los activos de Kostin en los Estados Unidos están congelados prohibiendole ingresar al EE.UU.

¿POR QUÉ EL BANCO ESTATAL RUSO VTB ES ES EL LARGO BRAZO DEL KREMLIN PARA PERSEGUIR A LA FAMILIA BITKOV?

1.VTB FUE QUIEN CONTRATÓ A CICIG para crear una causa penal de gran impacto.

VTB descubrió Bitkov en Guatemala en 2014, la pareja vivía allí con documentos de otras personas. El Banco del Estado tuvo que involucrar a la Comisión Internacional contra la Impunidad (CICIG), que opera bajo los auspicios de la ONU, para investigar sus actividades. En enero de este año, Bitkov y su hija Anastasia, un tribunal guatemalteco, fueron condenados por utilizar documentos falsos … Igor Bitkov recibió 19 años de prisión, Irina y Anastasia, 14 cada uno. 2. CICIG AYUDÓ A VTB a constituirse como querellantes adhesivos dentro de un proceso de Uso de documentos “supuestamente falsos”  Aduciendo de una “supuesta estafa” cometida por los esposos Bitkov en Rusia lo cual mas adelante resultó ser falso, ya que dicha entidad bancaria fue expulsada del proceso penal por falta de pruebas en contra de la familia Bitkov.

3. La Familia Bitkov es perseguida política del gobierno de Rusia.  Y como arma de persecución utiliza el Kremlin al Banco Estatal Ruso VTB. 

EL BANCO ESTATAL RUSO VTB Y SU LOBBY FRACASADO EN WASHINGTON 

VTB Bank después de la introducción de las sanciones estadounidenses contra su presidente, Andrei Kostin, redujo drásticamente la actividad de cabildeo en este país. De abril a septiembre de 2018, pagó al bufete de abogados estadounidense Sidley Austin, que representa sus intereses, $ 164.9 mil. Esto es casi dos veces menos que en el período del informe anterior: de octubre de 2017 a marzo de 2018, cuando los gastos alcanzaron los $ 307,000, según datos del Departamento de Justicia de los Estados Unidos.  (Fuente: https://www.rospres.com/politics/25837/)

Sidley Austin informó que por casi $ 165 mil ha hecho una cosa por VTB: el 26 de abril, la compañía envió un correo electrónico en nombre del banco a la Comisión de Helsinki para pedirles que presentaran la posición del banco ruso en una audiencia en Washington llamada “Injusticia de brazo largo: es la Comisión de la ONU”. La Comisión para la Seguridad y la Cooperación en Europa, también conocida como la Comisión de Helsinki, es un organismo del gobierno de los EE. UU. DESPUÉS DE LA COMISIÓN DE HELSINKI EL BUFETE QUE REPRESENTABA AL BANCO RUSO VTB RESCINDIÓ EL CONTRATO DE REPRESENTACIÓN

Se ha publicado una carta (. Pdf ) en el sitio web de la Comisión de Helsinki, el jefe del departamento legal de VTB, el vicepresidente senior Alexei Lozovoy, en el que niega cualquier acusación contra el banco.

Los representantes de  VTB aducen que no recibieron ningún aviso o invitación a la audiencia el 26 de abril y se enteró de ellos “en los tweets de William Browder”. pero a pesar de NO saber nada VTB envió su carta a la  Comisión de Helsinki!.

Según informó la agencia Ruspress , William Browder , condenado en Rusia en ausencia, habló en las audiencias de la comisión , afirmando que en Guatemala el empresario era el “brazo de Moscú” y su enjuiciamiento penal estaba estructurado en la misma línea que el caso Magnitsky .

Después de las audiencias, el copresidente de la Comisión de Derechos Humanos del Congreso de los Estados Unidos, James McGovern, y el miembro del comité de asuntos exteriores del Congreso, Elliot Ingle, hicieron un llamamiento a Jimmy Morales, Presidente de Guatemala, para que otorgue asilo político a los miembros de la familia Bitkov.

Tras los resultados de las audiencias del 26 de abril, la Comisión de Helsinki recomendó a los Estados Unidos rechazar las contribuciones al trabajo de la CICIG.

Los abogados de Sidley Austin no tuvieron ningún otro contacto con las autoridades estadounidenses en interés de VTB, ni siquiera intentaron cuestionar la inclusión del jefe de VTB Andrei Kostin en la lista de sanciones.

Esto sucedió en abril, cuando Estados Unidos endureció las sanciones contra Rusia. Los activos de Kostin en los Estados Unidos están congelados, y el propio banquero tiene prohibido ingresar al país.

  • La Injerencia de VTB (Kremlin) al contratar a CICIG logró que a la familia Bitkov le sentenciarán a condenas brutales de 14 y 19 años de prisión por el USO DE DOCUMENTOS DE IDENTIFICACIÓN oficiales los cuales nunca fueron redargüido de nulidad o falsedad.

Guatemalan President Jimmy Morales announced Friday that the agreement his country has with the United Nations Commission Against Impunity in Guatemala won’t be renewed. The commission—known by its Spanish acronym, CICIG—has one year to tie up its work and, by Sept. 3, 2019, leave the country.

Mr. Morales sent a letter to the U.N. secretary-general advising him of the decision. In a press conference Mr. Morales said that CICIG should immediately begin transferring its responsibilities to “corresponding [Guatemalan] entities,” mainly the attorney general.

On Monday CICIG’s top prosecutor, Colombian Iván Velásquez, flew to Washington, though he didn’t reveal why and has no public events scheduled. His spokesman said the trip had been planned for a while. It wouldn’t be the first time the prosecutor went north on a secret mission.

The U.S. Congress pays a substantial part of CICIG’s budget, but Mr. Velásquez has refused to answer questions at congressional hearings or in any public forum. Instead he meets behind closed doors on Capitol Hill, where he can control the narrative in front of an audience—both left and right—that is unfamiliar with or doesn’t care about CICIG’s transgressions against innocent Guatemalans. He also seems to have State Department sympathizers.

Mr. Morales’s detractors charge that he fired Mr. Velásquez to protect himself. CICIG has been investigating the president and alleges that he was the beneficiary of illegal campaign financing. He denies wrongdoing and enjoys immunity as long as he holds office. Mr. Velásquez has been working to lift that immunity.

Mr. Velásquez might successfully defend his commission if the standoff with the president were the only disputed issue. But under his leadership there is strong evidence that CICIG routinely flouts the rule of law and tramples civil liberties in violation of the Guatemalan constitution. His methods can’t be supported by a republic that pledges allegiance to transparency and human rights.

CICIG was born in 2006 and began its work in 2007. It was supposed to investigate criminal networks operating inside state institutions under a temporary mandate. U.S. and European Union support gave it enormous clout, and Guatemalans welcomed the idea of outside help to defeat corruption.

But over the years CICIG expanded its authority to advance the politics of the extreme left, which seeks to consolidate power by gaining control of institutions. It’s the same strategy employed by the late Venezuelan dictator Hugo Chávez.

Mr. Velásquez isn’t an elected official. He’s more of a modern-day viceroy, suppressing with force opposition in the “colony” from those who challenge his authority. Guatemalans have come to understand that to complain about the illegal methods of CICIG is to risk public condemnation as a friend of the corrupt—or even investigation and preventive detention. Shady businessmen, politicians, notorious thugs and especially judges seem to be given a pass so long as they embrace Mr. Velásquez’s agenda or stay out of his way. In other words, CICIG’s administration of justice has been selective.

Guatemalans have been afraid to speak out. But that changed when William Browder, a victim of Vladimir Putin’s global vengeance, defended the Bitkov family. The Bitkovs had fled Russia to escape Mr. Putin’s clutches but fell into the snare of human traffickers in Guatemala. Putin henchmen followed the family to Central America and enlisted the help of CICIG to jail them.

In April congressional hearings, Americans learned for the first time about Mr. Velásquez’s extralegal prosecution of the Bitkovs. CICIG had even thrown 3-year-old Vladimir Bitkov into a state orphanage, denying him his right to a legal guardian when his parents were carted off to prison. CICIG declined to send someone appear at the hearing and defend its actions. Perhaps now Guatemala’s attorney general can conduct a full investigation into what looks like collusion between Russia and CICIG.

Another egregious CICIG case is the jailing of Max Quirin, a well-respected Guatemalan businessman who has been denied the presumption of innocence and has been in captivity since May 2015. At his trial, CICIG was unable to present evidence of any crime yet Mr. Quirin has repeatedly has been denied bail or even house arrest.

The international left has cheered the murky influence and capriciousness of CICIG because it strong-arms and silences ideological opponents of socialism. In CICIG, socialists inside and outside the U.N. believed they had found a model they could plop down all over the developing world to weaken advocates of center-right ideas and empower collectivism, all under the pretense of fighting corruption. Rumors abound that the Constitutional Court, an ally of Mr. Velásquez, is getting ready to declare the president’s decision illegal. That would explain why, on Tuesday, Mr. Morales announced that Mr. Velásquez will not be allowed back in the country.

Mr. Morales’s decision to order army jeeps to the street in front of CICIG offices on Friday morning was unnecessary and counterproductive. His critics immediately accused him of intimidation and of militarizing the government. But the decision to expel the commission is his right as the elected leader of a sovereign nation, and he has ample justification.

Es inaudito lo que a continuación mostraremos a usted ya que ni el Ministerio Público, ni la Procuraduría General de la Nación se opusieron a que toda la familia de migrantes Bitkovs gocen del beneficio de libertad dado a que son migrantes .

¿POR QUÉ FUE A PUERTA CERRADA LA AUDIENCIA?

Por parte del abogado Luis Morales solicitó que esta audiencia fuera a puerta cerrada en virtud que los temas que se dilucidaron en dicha audiencia tenían que ver con los padecimientos de salud de Anastasia Bitkova por lo tutelando el pudor y la integridad física y mental de Anastasia fue ésta la razón por la cual se hizo la solicitud.

ESTOS FUERON LOS 5 ASPECTOS TRASCENDENTALES QUE EL ABOGADO ROLANDO ALVARADO ARGUMENTO PARA SOLICITAR EL OTORGAMIENTO DE MEDIDA SUSTITUTIVA A FAVOR DE ANASTASIA BITKOVA

(Por motivos médicos y de privacidad omitimos el audio pero mostramos su transcripción esencial de la solicitud del abogado Alvarado)

  1. Anastasia Bitkova e Irina Bitkova gogazam de Medida Sustitutiva desde el 15 de enero del año 2016, la cual fue cumplida a cabalidad sin embargo el 05 de enero de 2018 ilegalmente fue revocada la medida sustitutiva de Irina y Anastasia  ya que la Sentencia dictada por el tribunal de sentencia NO está firme hasta la fecha y esta ilegalidad fue cometida por la Jueza Yassmin Barrios quien ejecutó una sentencia que no ha causado firmeza.
  2. El día que ilegalmente Yassmín Barrios  revocó la medida sustitutiva de Anastasia Bitkova e Irina Bitkova dicha jueza no lo hizo con todos los sindicados, ya que el sindicado (OMITIMOS NOMBRE POR PRIVACIDAD) NO le fue revocada la medida sustitutiva debido a su condición médica en ese sentido se discrimino a Anastasia Bitkova porque obran múltiples dictámenes de INACIF donde consta que Anastasia NO puede estar en prisión debido a afecciones graves crónicas las cuales fueron respetadas por el Juez Miguel Ángel Gálvez para otorgarles medidas sustitutivas en el año 2016 PERO la Jueza Yassmin Barrios no le importaron y rococó dichas medidas empeorando la salud y la vida tanto de Anastasia Bitkova como de Irina Bitkova quien es responsable según obra en autos de la salud de su hija.
  3. No obstante que la medida sustitutiva fue revocada en forma ilegal LAS CONDICIONES PRIMITIVAS VARIARON ya que obran en autos 3 dictámenes periciales de INACIF donde se indica claramente de las afecciones médicas que padece Anastasia Bitkova  donde en uno de ellos se desprende la siguiente lectura “ANASTASIA BITKOVA NO ESTA EN CONDICIONES DE SER REFERIDA A NINGÚN CENTRO CARCELARIO EN ESTE MOMENTO O EN EL FUTURO DEBIDO AL POTENCIAL RIESGO SUICIDA”  Los expertos de INACIF le manifestaron a la Jueza Yassmin Barrios que “DE EXISTIR LA POSIBILIDAD DE UN ENCARCELAMIENTO ESTE NO ES RECOMENDABLE YA QUE ESTARÍA EN UN AMBIENTE HOSTIL Y POCO VIGILANTE LO CUAL PODRÍA CAUSAR INTENTOS DE SUICIDIO INMINENTE LO CUAL ES UN RIESGO LATENTE PARA LA VIDA DE LA PACIENTE… por lo que en su lugar se refiere un régimen de vigilancia domiciliaria.  Así mismo el propio Sistema Penitenciario mediante dictámenes médicos forenses determina en sus conclusiones que la Vida de Anastasia está en deterioro por lo que se recomienda tratamiento ambulatorio ya que el centro carcelario no cuenta con equipo médico de atención de emergencia por las afecciones que ahora presenta poniendo en riesgo su vida y favorecer la salud de la paciente.
  4. Cabe destacar que varios expertos médicos forenses de INACIF refiere a que debido a la condición psiquiátrica y medica que presenta Anastasia ella depende de su mamá Irina Bitkova ESTO ES MUY IMPORTANTE ya que estas condiciones médicas desde su inicio antes del año 2015 fueron médicamente comprobadas y documentadas que su mamá Irina ha sido quien le ha dado el soporte en los momentos donde han existido los intentos suicidas (documentados) y ella (Irina Bitkova) es quien lo ha impedido. A parte Igor Bitkov estuvo apartado de ella por 3 años y medio lo cual rompio el vinculo que existe con su hija Anastasia Bitkova por esa situación Anastasia Depende de su madre Irina Bitkova lo cual fue atendido por el Juez Miguel Ángel Gálvez para otorgar Medida Sustitutiva tanto a la Anastasia como a Irina ya que dicho juzgador respeto la vida y derechos humanos de ambas.
  5. Las Circunstancias del Proceso han variado por la Sentencia de AMPARO DEFINITIVO de Fecha 19 de octubre de 2017 dictada por la Sala Tercera de la Corte de Apelaciones Constituida en Tribunal de Amparo en dicha sentencia dice claramente que “Igor Bitkov NO PUEDE SER OBJETO DE PROCESO PENAL… pues Guatemala no puede dejar de observar una norma de carácter internacional como la Convención de Palermo” por lo tanto y dado a que Irina Bitkova y Anastasia Bitkova son Terceras Interesadas la Honorable Corte de Constitucionalidad en sentencia de fecha 25 de abril del año 2018 CONFIRMÓ en su totalidad y sin modificaciones la sentencia del tribunal de amparo ordenando que “LOS EFECTOS DEL AMPARO DEBEN HACERSE EXTENSIVOS AL NÚCLEO FAMILIAR DEL POSTULANTE IGOR BITKOV, LO QUE INCLUYE A SU ESPOSA E HIJA IRINA BITKOVA Y ANASTASIA BITVOVA”

A pesar del actuar malicioso de CICIG El resultado de esta audiencia fue positivo ya que se OTORGÓ MEDIDA SUSTITUTIVA A FAVOR de Irina Bitkova y Anastasia Bitkova

Mas sin embargo Irina Bitkova se pronuncia más tarde de la noticia poniendo en evidencia el temor que posee ante la amenaza que CICIG se empecine en no respetar la ley ni la constitución aunado a las condiciones médicas que afectan a su hija mediante el siguiente comunicado.

Se espera que en los próximos días Irina Bitkova y Anastasia Bitkova recobran su libertad ya que el ÚNICO ente que podría oponerse sería la CICIG evidenciando por completo si lo hace su postura política represiva y de tortura en contra de la familia de migrantes Bitkovs.

Jueza María Belén Reyna Salazar violó derechos del niño Bitkov

Jueza de la Ninez María Belén Reyna Salazar es declarada culpable de violar el derecho humano de la Niñez del niño Bitkov

Corte de Constitucionalidad confirma resolución condenatoria de la jueza de la Niñez.  Expediente 5024-2017.

El daño causado hacia la familia Bitkov por parte de  la Jueza de la Niñez, Abogada MARÍA BELÉN REYNA SALAZAR es grave e irreparable ya que torturó la vida del niño Bitkov.

A continuación compartimos la sentencia:

Está  jueza que supuestamente debe velar por la protección de los derechos de la Niñez, ha sido declarada culpable de violar deliberadamente los derechos del niño Vladimir Bitkov, por haberlo remitido, sin causa justificada, a un Orfanato y por haberle prohibido visitas de sus parientes, amigos y tutores.   

Cabe mencionar que también fue sancionada la Directora del Hogar “AMOR DEL NIÑO”, que es el Orfanato donde Vladimir fue maltratado (diente quebrado, cicatriz en la ceja, conjuntivitis y amebas).

La Corte de Constitucionalidad confirma fallo por medio del cual queda firme la resolución del 8 de febrero del 2016, dictada por el anterior Procurador de los Derechos Humanos, De León Duque, dentro del expediente REF. EXP. ORD. GUA. 4417-2015/UCI, que declaró:

a) Violación al derecho humano de la niñez y adolescencia, del que fue víctima un niño, al ser institucionalizado por la Jueza de Primera Instancia de la Niñez y Adolescencia del Área Metropolitana, y

b) comportamiento administrativo lesivo, contra los derechos e intereses del niño, señalando como responsable de la violación descrita a la abogada María Belén Reyna Salazar, Jueza de Primera Instancia de la Niñez y Adolescencia del Área Metropolitana, y a la señora Shyrel Osborne, Directora del “Hogar Amor del Niño”, por negarse a la supervisión del Procurador de los Derechos Humanos.

Hasta hoy ya han sido sancionadas 2 juezas que han perjudicado gravemente a la familia Bitkov.  La justicia guatemalteca inicia a formar precedentes de violación a la independencia judicial y de actuaciones judiciales ilegales, donde funcionarios del sistema de justicia participaron deliberadamente en perjuicio de la familia Bitkov.   Tenemos el caso de la Jueza ERIKA AIFÁN, quien se negó a dar cumplimiento a un fallo constitucional y quien fue sancionada con multa por su desobediencia y remitido el caso al Ministerio Público para las diligencias de Antejuicio.

A continuación compartimos resolución de la Honorable Sala Tercera de Apelaciones que sancionó a la Jueza Aifan y ordena al MP inicie diligencias de antejuicio.

Estamos seguros que otros jueces, fiscales y funcionarios en general, pronto serán sancionados por su actuar arbitrario y perjuidicial en contra de la familia Bitkov.  Estas sanciones también se gestionarán a nivel internacional.

Los buenos jueces y fiscales, deben unirse y dar señales de independencia judicial, sin interferencia, actuando de manera justa y apegada a Derecho, ya que esto sí fortalecerá el estado de Derecho en Guatemala.

In a kindly way I address to you with the means to communicate you the result of the letter sent to this Judicature on October 3rd, 2017, coming from the Sub Secretary of the Supreme Court of Justice in which we are order to comply with the ordered on the resolution dated September 13th of 2017 emanated of the Presidency of the Judicial Organism and of the Supreme Court of Justice, to issue a report related to the possible condemnations preview for the crimes imputed to the Russian Citizens IGOR BITKOV and IRINA BITKOVA.

From the foregoing, I allow myself to report the following, both defendants were sen to trial for the crimes of USURPATION OF CIVIL STATUS, USE OF FORGED DOCUMENTS and SUPPRESSION AND ALTERATION (sic), these crimes have the following penalties provided:

USURPATION OF THE CIVIL STATUS: Regulated in article 241 of the Penal Code, which establishes that who commits this crime will be punished with imprisonment of two to five years.

USE OF FORGED DOCUMENTS: Regulated in Article 325 of the Criminal Code, which establishes that whoever commits this crime will be punished with imprisonment of one to three years.

SUPPRESSION AND ALTERATION (sic): Regulated in Article 240 of the Criminal Code, which establishes that whoever commits this crime will be punished with imprisonment of five to eight years and a fine of Q.100,000 to Q.500,000 quetzales.

 Last month, I went to Guatemala to visit a family named Bitkov in their prisons. Igor, Irina, and Anastasia Bitkov fled Russia in fear of their lives. They wound up in Guatemala. In a Kafkaesque turn of events, they are now in prison. They were put there by a strange combination of Guatemalan legal authorities, a Russian bank, and a U.N. agency. You can read my story — the Bitkovs’ story, told by me — here.There is good news: Senator Marco Rubio has placed a hold on U.S. funding of the U.N. agency. And there is talk that Canada might accept the Bitkovs, in the event of their release. (Article here.)

A clutch of people have taken up the Bitkovs’ cause. Rubio is one of them. Bill Browder is another. (He is the financier who campaigns for “Magnitsky acts,” sanctioning human-rights abusers.) Mary Anastasia O’Grady of the Wall Street Journal has written repeatedly about the Bitkovs and their case.

I sat in prison with Irina Bitkov. She marveled at the help she and her family were getting. “We are not their fellow citizens,” she said of those helping the Bitkovs. “We can’t do anything for them. They are helping us simply because we are human beings.” She could hardly believe it. She thought it was the most marvelous thing in the world.

And as she spoke, I thought of the nationalists and realists (self-styled).

After I got back, I wrote about an incident from the Carter years. President Carter was meeting with Andrei Gromyko, the Soviet foreign minister. Carter brought up the case of Anatoly Shcharansky (later Natan Sharansky), the leading refusenik in the Gulag. Gromyko was nonplussed at this. The USSR and the USA had such big fish to fry: nuclear arsenals, the fate of the world. And Carter was bringing up this one zek, this one prisoner. He is but “a microscopic dot,” Gromyko said.

Today, my eyes fell on a piece by Vladimir Kara-Murza, the Russian democracy leader. Let me quote:

One morning in the spring of 2016, I spoke at a breakfast meeting with British members of Parliament who were on an official visit to Moscow. The conversation soon turned to the Magnitsky Act, the path-breaking U.S. measure that targeted individuals responsible for human rights abuses in Russia. When I urged my interlocutors to pass the same law in Britain, one member of the delegation broke me off and launched into a diatribe: why on earth, he complained, should the City of London forgo billions in profits because of some “human rights hearsay.”

Our meeting was taking place in the British ambassador’s residence, just a few hundred yards from the bridge where, months earlier, Russian opposition leader Boris Nemtsov was gunned down as he walked home after dinner. I was barely able to stand, using a cane, months after my own near-fatal poisoning. I had nothing to say to the honorable gentleman as he lamented the loss of profits.

“Human-rights hearsay,” “microscopic dots.” The national interest is paramount. It must always be thus. But we Americans find that, usually, our interest does not conflict with concern for human beings, for these little dots. It may be that they are, in fact, what makes life worth living.
