El 15 de noviembre de 2018 en la ciudad de Londres, fueron entregados los premios Sergei Magnitsky Human Rights Awards. Victoria Sandoval y Rolando Alvarado Abogados de la Familia Bitkov fueron distinguidos con esta magna presea

QUIEN FUE SERGEI MAGNITSKY

Cabe resaltar que los premios antes mencionados llevan el nombre del abogado y auditor ruso Serguei Magnitski fue cuyo arresto y posterior muerte en custodia atrajo la atención internacional ya que llevó a cabo investigaciones tanto oficiales como extraoficiales de fraude, robo y de serias violaciones de derechos humanos.

Magnitsky había alegado que hubo un robo a gran escala por parte del estado ruso sancionado y llevado a cabo por funcionarios rusos.

Sergei Magnitsky fue arrestado y eventualmente murió en prisión siete días antes de la expiración del plazo de un año durante el cual podía legalmente estar detenido sin juicio

La Ley Global Magnitsky fue aprobada en 2016 por el Congreso de los EEUU, es una norma estadounidense que se convierte en la lista negra para ciudadanos, influyentes empresarios y políticos señalados por abusos a los derechos humanos y actos de corrupción en sus propios países

Por tal razòn y en honor a este valeroso y aguerrido abogado quien fue muerto por defender la verdad y la justicia los premios de a los Derechos Humanos Sergei Magnitsky llevan su nombre.

Durante la audiencia del pasado 07 de julio del año 2018 el equipo legal de la familia Bitkova solicitó la revisión de la medida de coerción de Irina Bitkova y Anastasia Bitkova ambas privadas de libertad de manera ilegal por orden de Yassmín Barrios resultó que la ÚNICA persona que se opuso al otorgamiento de la medida sustitutiva a favor de ambas integrantes de la familia Bitkovs fue la Mandataria de CICIG Claudia Gonzalez.

Es inaudito lo que a continuación mostraremos a usted ya que ni el Ministerio Público, ni la Procuraduría General de la Nación se opusieron a que toda la familia de migrantes Bitkovs gocen del beneficio de libertad dado a que son migrantes .

¿POR QUÉ FUE A PUERTA CERRADA LA AUDIENCIA?

Por parte del abogado Luis Morales solicitó que esta audiencia fuera a puerta cerrada en virtud que los temas que se dilucidaron en dicha audiencia tenían que ver con los padecimientos de salud de Anastasia Bitkova por lo tutelando el pudor y la integridad física y mental de Anastasia fue ésta la razón por la cual se hizo la solicitud.

ESTOS FUERON LOS 5 ASPECTOS TRASCENDENTALES QUE EL ABOGADO ROLANDO ALVARADO ARGUMENTO PARA SOLICITAR EL OTORGAMIENTO DE MEDIDA SUSTITUTIVA A FAVOR DE ANASTASIA BITKOVA

(Por motivos médicos y de privacidad omitimos el audio pero mostramos su transcripción esencial de la solicitud del abogado Alvarado)

  1. Anastasia Bitkova e Irina Bitkova gogazam de Medida Sustitutiva desde el 15 de enero del año 2016, la cual fue cumplida a cabalidad sin embargo el 05 de enero de 2018 ilegalmente fue revocada la medida sustitutiva de Irina y Anastasia  ya que la Sentencia dictada por el tribunal de sentencia NO está firme hasta la fecha y esta ilegalidad fue cometida por la Jueza Yassmin Barrios quien ejecutó una sentencia que no ha causado firmeza.
  2. El día que ilegalmente Yassmín Barrios  revocó la medida sustitutiva de Anastasia Bitkova e Irina Bitkova dicha jueza no lo hizo con todos los sindicados, ya que el sindicado (OMITIMOS NOMBRE POR PRIVACIDAD) NO le fue revocada la medida sustitutiva debido a su condición médica en ese sentido se discrimino a Anastasia Bitkova porque obran múltiples dictámenes de INACIF donde consta que Anastasia NO puede estar en prisión debido a afecciones graves crónicas las cuales fueron respetadas por el Juez Miguel Ángel Gálvez para otorgarles medidas sustitutivas en el año 2016 PERO la Jueza Yassmin Barrios no le importaron y rococó dichas medidas empeorando la salud y la vida tanto de Anastasia Bitkova como de Irina Bitkova quien es responsable según obra en autos de la salud de su hija.
  3. No obstante que la medida sustitutiva fue revocada en forma ilegal LAS CONDICIONES PRIMITIVAS VARIARON ya que obran en autos 3 dictámenes periciales de INACIF donde se indica claramente de las afecciones médicas que padece Anastasia Bitkova  donde en uno de ellos se desprende la siguiente lectura “ANASTASIA BITKOVA NO ESTA EN CONDICIONES DE SER REFERIDA A NINGÚN CENTRO CARCELARIO EN ESTE MOMENTO O EN EL FUTURO DEBIDO AL POTENCIAL RIESGO SUICIDA”  Los expertos de INACIF le manifestaron a la Jueza Yassmin Barrios que “DE EXISTIR LA POSIBILIDAD DE UN ENCARCELAMIENTO ESTE NO ES RECOMENDABLE YA QUE ESTARÍA EN UN AMBIENTE HOSTIL Y POCO VIGILANTE LO CUAL PODRÍA CAUSAR INTENTOS DE SUICIDIO INMINENTE LO CUAL ES UN RIESGO LATENTE PARA LA VIDA DE LA PACIENTE… por lo que en su lugar se refiere un régimen de vigilancia domiciliaria.  Así mismo el propio Sistema Penitenciario mediante dictámenes médicos forenses determina en sus conclusiones que la Vida de Anastasia está en deterioro por lo que se recomienda tratamiento ambulatorio ya que el centro carcelario no cuenta con equipo médico de atención de emergencia por las afecciones que ahora presenta poniendo en riesgo su vida y favorecer la salud de la paciente.
  4. Cabe destacar que varios expertos médicos forenses de INACIF refiere a que debido a la condición psiquiátrica y medica que presenta Anastasia ella depende de su mamá Irina Bitkova ESTO ES MUY IMPORTANTE ya que estas condiciones médicas desde su inicio antes del año 2015 fueron médicamente comprobadas y documentadas que su mamá Irina ha sido quien le ha dado el soporte en los momentos donde han existido los intentos suicidas (documentados) y ella (Irina Bitkova) es quien lo ha impedido. A parte Igor Bitkov estuvo apartado de ella por 3 años y medio lo cual rompio el vinculo que existe con su hija Anastasia Bitkova por esa situación Anastasia Depende de su madre Irina Bitkova lo cual fue atendido por el Juez Miguel Ángel Gálvez para otorgar Medida Sustitutiva tanto a la Anastasia como a Irina ya que dicho juzgador respeto la vida y derechos humanos de ambas.
  5. Las Circunstancias del Proceso han variado por la Sentencia de AMPARO DEFINITIVO de Fecha 19 de octubre de 2017 dictada por la Sala Tercera de la Corte de Apelaciones Constituida en Tribunal de Amparo en dicha sentencia dice claramente que “Igor Bitkov NO PUEDE SER OBJETO DE PROCESO PENAL… pues Guatemala no puede dejar de observar una norma de carácter internacional como la Convención de Palermo” por lo tanto y dado a que Irina Bitkova y Anastasia Bitkova son Terceras Interesadas la Honorable Corte de Constitucionalidad en sentencia de fecha 25 de abril del año 2018 CONFIRMÓ en su totalidad y sin modificaciones la sentencia del tribunal de amparo ordenando que “LOS EFECTOS DEL AMPARO DEBEN HACERSE EXTENSIVOS AL NÚCLEO FAMILIAR DEL POSTULANTE IGOR BITKOV, LO QUE INCLUYE A SU ESPOSA E HIJA IRINA BITKOVA Y ANASTASIA BITVOVA”

In a kindly way I address to you with the means to communicate you the result of the letter sent to this Judicature on October 3rd, 2017, coming from the Sub Secretary of the Supreme Court of Justice in which we are order to comply with the ordered on the resolution dated September 13th of 2017 emanated of the Presidency of the Judicial Organism and of the Supreme Court of Justice, to issue a report related to the possible condemnations preview for the crimes imputed to the Russian Citizens IGOR BITKOV and IRINA BITKOVA.

From the foregoing, I allow myself to report the following, both defendants were sen to trial for the crimes of USURPATION OF CIVIL STATUS, USE OF FORGED DOCUMENTS and SUPPRESSION AND ALTERATION (sic), these crimes have the following penalties provided:

USURPATION OF THE CIVIL STATUS: Regulated in article 241 of the Penal Code, which establishes that who commits this crime will be punished with imprisonment of two to five years.

USE OF FORGED DOCUMENTS: Regulated in Article 325 of the Criminal Code, which establishes that whoever commits this crime will be punished with imprisonment of one to three years.

SUPPRESSION AND ALTERATION (sic): Regulated in Article 240 of the Criminal Code, which establishes that whoever commits this crime will be punished with imprisonment of five to eight years and a fine of Q.100,000 to Q.500,000 quetzales.

A United Nations prosecutor partly funded by the U.S. was supposed to be a cure for corruption in Guatemala. But the U.N. International Commission Against Impunity in Guatemala—or CICIG by its Spanish initials—has had almost no oversight since it was established in 2006. Now it too is accused of corruption and politicizing the judiciary.

There’s nothing strange about absolute power run amuck. But it is weird that an army from the State Department, nonprofits and some business groups are resisting sunlight for a U.N. body that answers to no one.

The good news is that Republican Sens. Roger Wicker (Miss.), Marco Rubio (Fla.) and Mike Lee (Utah) and Rep. Chris Smith (R., N.J.) are more insistent. On Monday they sent a letter to the Chairman of the House subcommittee on state and foreign operations, Rep. Hal Rogers (R., Ky.), requesting a hold on a $6 million disbursement for CICIG until “Congress has conducted appropriate oversight.”

The signers are alarmed by the testimony of Guatemalan lawyers for the Russian family of Igor Bitkov at a Helsinki Commission hearing in Washington on April 27. The attorneys recounted the violations of civil liberties that the family has suffered at the hands of CICIG in cooperation with a Russian bank and the Guatemalan attorney general. CICIG refused to answer questions before the commission.

Guatemala’s constitutional court has upheld a ruling that the family are migrants and committed only administrative offenses. But rather than release them, on Wednesday a lower-court judge delivered a written order for a new trial for Mr. Bitkov.

CICIG is an unelected U.N. body and lead prosecutor Iván Velásquez has the power of a viceroy. He has cowed many locals into supporting him if they want to stay out of jail. Others are cheering him on as he threatens to bring down President Jimmy Morales. That’s something to keep in mind as CICIG advocates bombard Capitol Hill to defend CICIG’s unchecked authority.

Their best argument is that CICIG has done some good things. Yet that will come out in any investigation—as will abuses of power. If Republican chairmen with the authority over taxpayer money have any interest in stabilizing Central America, they will halt the CICIG financing and begin a review.

Backers of efforts to combat corruption in Guatemala are vowing that work will not be stopped by U.S. Sen. Marco Rubio putting a hold on $6 million in U.S. contributions for a U.N.-sponsored commission probing graft in the country.

Commission chief Ivan Velasquez said he would not comment but tweeted Sunday: “The fight against impunity and against corruption must continue; it does not wait; it cannot be suspended or delayed. There is neither time nor space for pessimism, uncertainty, discouragement or fear.”

Guatemalan lawmaker Andrea Villagran said Monday that lobbyists in Washington are misinterpreting the fight against corruption in Guatemala and is hopeful that Rubio’s request will not last.

“What Senator Rubio says should not do significant harm, since it is not a person who makes decisions — it is a group,” she said. “And we understand U.S. politics. They are institutional regardless of whether Democrats or Republicans are in power.”

Rubio announced the hold Friday, which affects funding already authorized by Congress but not yet disbursed.

In a statement, he said he was concerned the commission may have been “manipulated and used by radical elements and Russia’s campaign against the Bitkov family in Guatemala.”

Guatemala’s highest court recently overturned a prison conviction for the three Bitkovs, who were accused of using forged documents to live in the country. They claim to be the victims of a plot orchestrated by Moscow but have produced no evidence to support their allegation.

Rubio also sent a letter to Guatemalan President Jimmy Morales asking him to guarantee the Bitkovs’ safety.

Left-wing NGOs circle the wagons around a rogue U.N. commission.

The “caravan” of Central Americans at the southern U.S. border seeking asylum has some conservatives wringing their hands about a Hispanic invasion. They should instead be asking what’s behind the destabilization of the countries these desperate migrants have fled.

Central American corruption, statism and crony capitalism have led to poverty and exclusion. The region’s classical liberals understand this connection and have fought to strengthen the rule of law. But their efforts have been undermined by the drug trade financing criminal networks that overwhelm institutions.

Now there is substantial evidence that a U.S.-funded fix for the problem in Guatemala, using a United Nations prosecutor, has itself been corrupted by unscrupulous actors and left-wing U.N. ideology.

As I wrote last month, the U.N. body is the International Commission on Impunity in Guatemala, or CICIG by its Spanish initials. It was established in 2006 with the best intentions to investigate the crimes of underworld networks. But the U.S. Helsinki Commission hearing on Capitol Hill last week revealed vile human-rights abuses by CICIG prosecutors in a case involving a family of Russian migrants—the Bitkovs. The case raises questions about whether CICIG has gone rogue.

That is unless you are one of many nongovernmental organizations and media operations working in Guatemala that are funded by George Soros’s Open Society Foundations and fellow travelers. In that case your instructions are to circle the wagons to defend CICIG prosecutor Iván Velásquez and destroy those who dare suggest that the case be judged on its merits.

This rush to dismiss flagrant violations of the law heightens concerns in Guatemala that CICIG has become a political tool of the NGO left. Americans are rightly asking why the U.S. finances this U.N. operation devoid of accountability and transparency.

The Helsinki Commission hearing on April 27 illuminated the case of Igor and Irina Bitkov and their daughter Anastasia. They fled persecution in Vladimir Putin’s Russia and landed in Guatemala where they became victims of a human-trafficking scam. CICIG prosecuted the family as criminals, in cooperation with a Kremlin-owned bank, and put them in jail, flouting a constitutional court ruling.

Bitkov lawyer Victoria Sandoval recalled how CICIG and local prosecutors raided the family home with overwhelming force in January 2015. The three were detained in cages in the courthouse basement. Despite a 24-hour legal limit on such confinement, Irina and Anastasia spent five days there; Igor nine.

The couple named a guardian for their 3-year-old son, Vladimir. But officials instead sent him to an orphanage where he suffered physical and psychological abuse. Harold Augusto Flores Valenzuela, the government official in charge of child welfare at the time, told Igor later that a CICIG official had instructed him to do whatever necessary to put the child in the orphanage. Mr. Bitkov signed an affidavit swearing to this conversation with Mr. Flores and it was entered into the record at the Helsinki hearing.

CICIG, the Guatemalan prosecutor, and the Russian bank VTB took the family to court for using fake documents that the Bitkovs thought were real. Igor was sentenced to 19 years in jail; Irina and Anastasia 14 years each. A month later the same judge reviewing the same offenses by two members of the Salvadoran gang MS-13, handed down five-year suspended sentences and released the defendants.

CICIG’s violations of civil liberties and its Russian collusion have been public for weeks. Yet an NGO letter-writing campaign aimed at defending the U.N. body at the Helsinki hearing refused to acknowledge the horror. The letters, posted on the commission’s website—along with the Bitkov lawyers’ testimony—are notable for their similarity and their callousness toward the Russian family, who are still in jail despite a constitutional court ruling 10 day ago to release them.

Such contradictions can only be explained by following the dollars spread around to so-called human-rights groups by those who share the politics of the unelected Mr. Velásquez. One goal of these moneyed elites was to end international adoptions, and he has used his authority to influence judicial rulings to do just that. His arbitrary rule with no oversight has put fear into the hearts of law-abiding Guatemalans; he has a reputation for pressuring judges, which has increased investor uncertainty in a country that already has trouble attracting capital. He has even tried to change the constitution.

In a statement made to the Helsinki Commission hearing, Sen. Mike Lee (R., Utah) noted that while CICIG was “created to root-out corruption and uphold the rule of law” it “has become an extrajudicial, partial and unfair arbiter.” Its politicization, he wrote, is “unfair to all who seek a free and prosperous Guatemala.” Something to think about as those busloads of refugees arrive at the border.

Yassmin Barrios Deja libres a integrantes de la Mara Salvatrucha

Sentencia dictada por Yassmín Barrios a favor de 2 prófugos miembros de la mara Salvatrucha, impactó al Senado de EE.UU.,  ya que no los envió a prisión por adquirir DPI falsos.

En el Senado de EE.UU.  llamó mucho la atención la condena dictada por el Tribunal de Sentencia presidido por Yassmín Barrios, dentro del proceso penal C-01031-2017-00005, debido a que un mes después de condenar a los Bitkov con penas brutales de  19 y 14 años de prisión y expulsión del país por adquirir de un traficante documentos de identidad emitidos por el Estado de Guatemala, condenaron, por ese mismo delito, a 2 salvadoreños miembros de la peligrosa mara Salvatrucha, con penas de 5 años de prisión conmutables (no fueron enviados a la cárcel).

Estos pandilleros, de nacionalidad salvadoreña, tenían agravantes en su actuar, debido a que ellos, contrario a los Bitkov, sí robaron la identidad de guatemaltecos, ya que utilizaron el nombre y apellido de guatemaltecos que sí existían, además, huyeron de El Salvador donde habían cometido más de 25 asesinatos; sin embargo, el mismo Tribunal que condenó a los Bitkov, no envió a prisión a estos miembros de la mara Salvatrucha.  Además, ese mismo Tribunal no ordenó la expulsión de Guatemala de estos pandilleros salvadoreños.

Los peligrosos pandilleros beneficiados por el Tribunal de Yassmín Barrios, son: Israel Antonio Cabrera Luna, alias “demonio”, y Mauricio Antonio Rivas Hernández, alias “Cabra” o “Patoja”.  Estos pandilleros, contrario a los empresarios rusos Bitkov, son asesinos peligrosos y extorsionan en Guatemala.

CICIG no fue querellante en contra  de estos peligrosos pandilleros a pesar de que ellos sí forman parte de una peligrosa estructura criminal (mara Salvatrucha); en cambio, la familia rusa Bitkov, nunca formó parte de estructura criminal alguna y, en cambio, CICIG sí pidió ser querellante en su contra para pedir las condenas brutales ya mencionadas.

IMPORTANTE: Después de haber leído la sentencia juzgue usted como el MP miente a la población mediante su portal de “noticias” institucional el cual hizo alarde de condenar a dos integrantes de la MS 13 sin mencionar que las  “condenas” fueron de tan solo 5 años conmutables los cuales fueron otorgados por la Jueza Yassmín Barrios.

Esto constituye una de las tantas ilegalidades del caso Bitkov, y es por ello que el Senado de EE.UU. está investigando la injerencia rusa en el actuar de CICIG y de los jueces y fiscales a cargo del proceso penal.
